Guardianship
Guardianship is a court process through which a third person, known as the “guardian,” is appointed to make decisions for another individual, called the alleged incapacitated party, also known as the A.I.P. To obtain guardianship over another involves the filing of a complaint and certifications. In New Jersey, two doctors must render reports supporting the conclusion that the AIP is in fact incapacitated. Eventually, there must be either a trial or guardianship by consent.
